These SMS Terms & Conditions (“Terms”) govern your participation in the Vocal Majority text messaging program (the “Program”), operated by Vocal Majority, a nonprofit organization based in Texas. By opting in, you agree to receive SMS messages from Vocal Majority in accordance with these Terms.

1. Program Description

By subscribing to the Vocal Majority SMS Program, you may receive recurring messages related to:

  • Concert announcements and event reminders
  • Ticket availability and purchasing opportunities
  • Donor updates and nonprofit initiatives
  • Special promotions, recordings, and exclusive content 

Message frequency varies based on user interaction and organizational activity.

2. Opt-In & Consent 

By providing your mobile number and opting in via a Vocal Majority form, website, or other subscription method, you expressly consent to receive recurring automated marketing and informational text messages. 

  • Consent is not a condition of any purchase or donation
  • Messages may be sent using an automatic telephone dialing system (ATDS), where applicable
  • Opt-in records are maintained in accordance with Mailchimp requirements

You must be at least 18 years old or have parental/guardian permission to enroll.

3. Message & Data Rates

Message and data rates may apply based on your mobile carrier and plan. Charges are billed and payable to your mobile service provider. Vocal Majority does not charge for SMS messages but is not responsible for any carrier-related fees.

4. Opt-Out Instructions 

You may opt out of the Program at any time by: Replying STOP to any message

After you send STOP, you will receive a one-time confirmation message and no further messages will be sent unless you re-subscribe.

6. Supported Carriers & Delivery Disclaimer

Supported carriers may include (but are not limited to): AT&T, Verizon, T-Mobile, Sprint, and other regional providers.

  • Carriers are not liable for delayed or undelivered messages
  • Delivery is subject to effective transmission by your carrier network 

7. Privacy & Data Use (Nonprofit Considerations)

 Vocal Majority respects your privacy and is committed to protecting your personal information.

  • Your mobile number and opt-in data will be used solely for Vocal Majority communications 
  • We do not sell, rent, or share your information with third parties for their marketing purposes
  • Data is stored and processed through Mailchimp in accordance with applicable data protection laws

8. User Responsibilities

By participating in the Program, you agree to:

  • Provide accurate, current, and complete information
  • Notify us promptly if your mobile number changes
  • Use the service only for lawful purposes

9. Texas-Specific Legal Notice

In accordance with applicable Texas laws, including the Texas Deceptive Trade Practices Act:

  • Vocal Majority will not engage in misleading or deceptive messaging practices
  • All promotional and fundraising communications will be clearly identified
  • You retain all rights under Texas consumer protection laws

If you are a Texas resident and believe your rights have been violated, you may contact the Texas Attorney General’s Office.

10. Nonprofit Disclosure

Vocal Majority is a nonprofit organization. SMS communications may include:

  • Invitations to support our mission through donations
  • Updates on programs and community impact

Participation in the SMS Program does not obligate you to make any donation.

11. Limitation of Liability

To the fullest extent permitted by law, Vocal Majority shall not be liable for:

  • Delayed or undelivered messages
  • Errors in message content
  • Any damages arising from participation in the Program

12. Changes to Terms

We reserve the right to modify these Terms at any time. Updates will be posted with a revised effective date. Continued participation constitutes acceptance of those changes.
